Every now and then, a news story appears about someone wearing a nazi uniform. It almost always leads to outrage and public debate. But is wearing a nazi uniform actually illegal? Or simply offensive? In this article, I explain when it is punishable and which factors play a role.

Is wearing a nazi uniform illegal in the Netherlands?

During the pandemic, a group of young people joined a protest while wearing nazi uniforms. They wore grey uniforms with matching boots. The original version of this uniform can be seen in the illustration above.

Footage showed that one of the boys held another person, dressed as a prisoner, at gunpoint. The group also repeatedly performed the Hitler salute. Images of the incident circulated widely on social media.

The group stated that they did not intend to promote nazi ideology. Instead, they claimed they wanted to express their opinion that government actions were comparable to those during the Second World War.

According to emeritus professor of criminal law Theo de Roos, the situation is complex. In an interview, he explained that wearing such symbols is not automatically illegal in the Netherlands. It becomes punishable when someone uses nazi symbols to express support for the ideology or to discriminate against Jewish people.

Freedom of expression plays a major role. In the Netherlands, a lot is allowed, as long as it does not lead to discrimination or disturb public order. The line between freedom of expression and criminal behaviour can therefore be very thin.

 

Wearing a nazi uniform not always illegal in the Netherlands

The Hitler salute, the uniforms, and the staged prisoner scene did not provide enough grounds to prosecute the group. Later, the young people gave a different explanation. They said they had organised a themed party for a friend who had been at sea for two weeks. Because the theme was military, they bought nazi uniforms from a costume shop.

This raises an interesting question: why can you legally sell a nazi uniform, while wearing it can sometimes be punishable?

In 2024, authorities ordered AliExpress to remove Belgian police uniforms that were offered as replicas. Four years earlier, another website had to remove imitation ambulance uniforms.

In the case of police and ambulance uniforms, you cannot wear them without having that role, as this can easily mislead others. A nazi uniform, however, is no longer in active use and is considered a historical garment. This makes the legal situation different.

 

In which countries is wearing a nazi uniform illegal?

While in the Netherlands context determines whether wearing a nazi uniform is punishable, other countries apply stricter rules.

In Germany, the Criminal Code (Strafgesetzbuch) contains a specific provision. Section 86a bans symbols such as SS runes, the swastika, and the Hitler salute. Violating this law can lead to fines or prison sentences of up to three years. The law does allow exceptions for education, art, or scientific purposes.

Austria introduced similar legislation in 1947 and bans both the use and distribution of nazi symbols and uniforms. Violations can lead to severe penalties.

Countries such as Poland, Israel, Lithuania, Hungary, the Czech Republic, Slovakia, and France also restrict or prohibit the public display of nazi symbols. In these countries, context still plays an important role.

In many Latin American countries and in the United States, the law does not always prohibit wearing a nazi uniform. These countries place stronger emphasis on freedom of expression. However, context still matters. Authorities can still arrest individuals for disturbing public order, disorderly conduct, or hate speech.

 

Is a nazi uniform illegal?

Wearing a nazi uniform is not always punishable. In the Netherlands, context plays a key role, while other countries apply stricter rules.

What is considered freedom of expression in one situation may lead to prosecution in another. That is what makes this topic so complex.

Because even when something is not illegal, it does not mean it is socially accepted.
